The Employment Rights Bill will make employers liable for a wide range of harassment experienced by their staff from third parties, unless they have taken all reasonable steps to prevent it.
The duty is more onerous than the previous law on third party harassment which was repealed over 10 years ago. The new focus will be on what you have done to prevent your staff from being harassed, rather than whether it has happened before.
This legislation will impact you if your staff come into contact with people you don’t control. Employers in the retail, hospitality and education sectors will face the biggest risks.
Throughout the session we'll address the following questions:
- Do you have to police ‘banter’ by customers or other third parties that might offend your staff even if it’s not directed at them?
- How will harassment be judged? Is there an objective element or is the subjective perception of your staff enough?
- What reasonable steps should you take to control the behaviour of third parties?
- How do you balance the rights of third parties to express their views and opinions with worker’s rights to a private life (which include protection against bullying and sexual harassment at work)?
- How to prepare for the new duty.
