In 2025 we submitted a Freedom of Information (FOI) request to quantify delays attributable to the Gateway 2 checkpoint as set out in the Building Safety Act. Since then, there has been a lot of criticism of the regime and much change including the recent separation of the Building Safety Regulator from the Health and Safety Executive, a move that we are hopeful will prove to be a positive step in the right direction.
However our recent FOI request into Gateway 3 decision making reveals that delays remain a significant challenge; and the BSR’s updated guidance emphasising stricter compliance expectations mean it’s more important than ever that applicants prepare high-quality, fully evidenced submissions in order to avoid additional delays.
